Hoody website (”Website”) and Hoody Desktop Application (“App”) available on hoody.com are owned and operated by Hoody Network (BVI) Ltd.

Throughout the Website, the terms “we”, “us”, “Hoody”, and “our” refer to Hoody Network (BVI) Ltd. We provide Hoody Website and App, and all information and services (“Services”) available to you conditioned upon your acceptance of all our Terms of Services (“Terms”) and Privacy Policy.

By visiting our Website, and/or by downloading and installing the App, and/or by using the free trial and/or the paid version of our Services, you acknowledge that you have read our Terms, understand them, and agree to be bound by these Terms. If you do not agree with our Terms, you should not install the App and use the Services. These Terms apply to all users of the Website, the App and the Services including without limitation visitors, users, and contributors of content.

General Information

  • What is Hoody. Hoody is an Encrypted Network. When you browse with Hoody, websites are being accessed indirectly through remote servers which act as shields, your IP and fingerprints are fully protected, the websites you visit can no longer track your online activity.

  • Sole discretion. We reserve the right to add or discontinue any Services anytime at our sole discretion and without notice. We also reserve the right to take appropriate steps to protect Hoody and/or its users from any abuse or misuse as it deems appropriate at our sole discretion.

App Updates and Functionality

From time to time, updates of the App may be available through the Website or the App. Depending on the update, you may experience malfunctions or bugs until you have installed the latest version. In addition, you acknowledge that the App is utilized over the Internet and mobile networks and so the availability of the App may be affected by factors outside our reasonable control. Accordingly, we do not accept any responsibility for any connectivity issues that you may experience when using the App. In addition, you acknowledge and agree that you are responsible for obtaining and maintaining all telecommunications, broadband and computer hardware, equipment and services needed to access and use the App.

Permitted use

You agree to use the Website, App and the Services only for purposes that are permitted by these Terms and in compliance with all applicable laws, regulations, and generally accepted practices or guidelines in the relevant jurisdictions. You may only use the Services for your non-commercial, non-exclusive, non-assignable, non-transferable, and limited personal use, and no other purposes.

You will not (and will not attempt to):

  • Use the Services for any illegal or unlawful purpose;

  • Access any of the Services by any means other than through the App that is provided by Hoody;

  • Gain unauthorized access to the Hoody network or engage in any activity that interferes with the performance of, or impairs the functionality or security of the Services;

  • Access any of the Services through any automated means or with any automated features or devices (including use of scripts or web crawlers);

  • Reproduce, duplicate, copy, sell, trade, or resell any aspect of the Services for any purpose; and

  • Reproduce, duplicate, copy, sell, trade or resell any products or services bearing any trademark, service mark, trade name, logo or service mark owned by Hoody

Limited License

We grant you a non-exclusive and limited license to download our App and use our Services. Modification, distribution to unauthorized parties, reverse engineering, or any other unauthorized use of Hoody is prohibited.

Hoody Key

Before you download and install the App, you can generate a unique Hoody Key, which is required to access to the Services. A Hoody Key is a cryptographic Key system that replaces the concept of account. It guarantees you total anonymity when you sign up. Read the ‘Hoody Key’ section of our Privacy Policy to learn how we protect your privacy with Hoody Keys.

You are solely responsible for maintaining the confidentiality of your Hoody Key and for restricting access to your computer and mobile devices. You may not share your Hoody Key to another person or entity. A Hoody Key grants you a license to use the Services on 5 devices simultaneously.

Free Trial

We offer a 14 day free trial with full and unrestricted access to the Services. Your name, email and credit card are Not required. At the end of the trial period, you can purchase Hoody if you want to continue using the Services.

Authorized Resellers

Authorized resellers are business partners that have entered into a contractual relationship with Hoody Network (BVI) Ltd to promote, advertise and sell the Services through Hoody website or on their own. Authorized resellers enable us to offer our Services to a broadest audience. Should you purchase our Services through our website via an authorized reseller, the same Terms of Service and Privacy policy apply. SecureBytes Network Limited is an authorized reseller of our Services.

Payments

At the end of your free trial period, your Hoody Key can be credited by most credit cards, cryptocurrencies, PayPal, or cash in some regions. These payment methods are offered by multiple third-party payment companies and their policies shall prevail upon their use.

Certain payment methods are only available through our authorized resellers, this will be shown during payment.

Auto renewal subscription is only available with payments made by PayPal. It must be cancelled on PayPal website.

Refunds and Cancellation

Our Services are on a Try-Before-You-Buy basis. At the end of the 14 day free trial period, if you decide to subscribe, we do not offer a refund after subscription.

Delete your Hoody Key

You can delete your Hoody Key permanently from the App. Once your Hoody Key is deleted, all the related profiles and configurations will be permanently lost.

Intellectual Property Rights

Your use of the Website, App and its contents grants you no rights over all copyrights, trademarks, service marks, patents, trade secrets and other intellectual property rights.

All Content, including designs, images, videos, graphics, animation, text, and related intellectual property rights mentioned or displayed on the Website or on the App, are protected by intellectual property laws. Any unauthorized reproduction, redistribution or other use of the Content is prohibited. You may use the Content only with our prior written and express authorization.

Disclaimer

The Services rely on third party providers such as server hosting providers, therefore we cannot be held responsible for unavailability of the Services when factors are beyond our control. We always put our best effort to ensure a seamless usage of the Services.

Limitation of Liability

You agree that in no event shall Hoody be liable to you, or any third party, for any direct or indirect damages arising out of or in connection with the use of the Services. You agree that you use the App and/or any Third Party Sites at your own risk. You understand and agree that we are not responsible or liable for your illegal, unauthorized, or improper use of information transmitted, monitored, stored or received using our Services.

Indemnification

You agree to indemnify and hold Hoody and its subsidiaries, affiliates, officers, directors, agents, and employees, harmless from and against any suit, action, claim, demand, penalty or loss, including attorneys’ fees, made by or resulting from any third party due to or arising out of your use of our Services, breach of these Terms or the materials it incorporates by reference, or your violation of any law, regulation, order or other legal mandates, or the rights of a third party.

Dispute Resolution & Governing Laws

In the event of a dispute arising out of or in connection with these Terms or any contract between you and us, you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.

These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands, excluding its rules governing conflicts of law. You hereby irrevocably consent to the exclusive jurisdiction of the British Virgin Islands in all disputes arising out of or related to the use of the Website or our Services.

Language and translation

The content of our Website and App was originally written in English language. Our team translated it afterward with best efforts. If there is any discrepancy between the original content in English and its translation in other languages, English prevails. Please contact our Customer support if you notice a discrepancy.

Changes

We may update at any moment our Terms without notice. We recommend you to review our Terms from time to time in order to stay informed on our revised rules. If any major change is made, we will send a notification in our communities.

Hoody Key

Hoody does not have a concept of Account, as accounts could eventually be linkable to payments. Instead, we've built our own cryptographic Key system, called Hoody Key. Hoody Key guarantees you a total anonymity when you sign-up. To generate your Hoody Key, we do not request for any of your personal information, not even your name or your email.

Additionally, we only store in our database a hashed version of your Hoody Key (Double SHA256 + Custom Seed). Our databases are encrypted using the highest standard possible.

Collect of personal information

We do not ask or collect any of your personal information. No privacy provider should ever ask for it.

Payments

At the end of your free trial period, your Hoody Key can be credited by most credit cards, cryptocurrencies, PayPal, cash in some regions, and other payment methods.

Some of our third party payment providers may require your personal information in order to validate your order, as part of their anti-fraud measures. We do not store the payment information that you provide on their website after your purchase of Hoody is completed. We do not access or extract the data from any of our third-party payment providers’ websites, in order to further secure your personal information.

Your Hoody Key cannot be linked to your payment, even if you input your personal information on third party payment providers’ websites (see the ‘Anonymisation of payment’ section for more information). However, we always encourage the use of Cryptocurrencies for ethical reasons, we accept most of them.

Anonymisation of payments

No matter which method of payment you use, the payment as well as the information used during the payment is not linkable to your Hoody Key.

When you purchase a subscription, the third-party payment provider does not see your Hoody Key. We only send a Signed Random Cryptographic ID (Secure Payment ID) to the payment provider. When your payment is completed, you are redirected to Hoody's website, the Secure Payment ID is validated and a duration is credited to your Hoody Key. The Secure Payment ID is then permanently deleted from our database to ensure that no-one else can use it to credit another account.

In case of a legal request, we cannot link (ever) a payment to a Hoody Key, even when using traditional payment methods such as PayPal.

As we cannot establish the ownership of a Hoody Key, we are not able to offer a refund or to retrieve a lost Hoody key. Please don't lose it.

Customer Support

You can communicate securely with our team from the support and contact pages of our website. Every messages passing through our secure ticket system is encrypted and only designated staff can read it. When you delete a message or a thread in our secure ticket system, it is permanently deleted, even for us.

Alternatively, you can reach us for general inquiries via email at contact. Should you choose to contact us via email, we strongly recommend you to encrypt your communication using our PGP Public Key. Support inquiries are only accepted through the secure ticket system of our support page.

We permanently delete every tickets and emails that have been closed or replied after 7 days.

Applicable law and jurisdiction

In order to protect the privacy of our users, Hoody operates from the British Virgin Islands (BVI), an offshore jurisdiction which has some of the strictest laws regarding disclosure of information. By being based in the BVI, Hoody Network (BVI) Ltd is in a legal capacity to not log any data of its users.

We do not know your name, email address, and we do not keep any log about your activity, therefore we would not be able to disclose any information about you, even if we were forced to by the BVI Supreme court.

No-Log Policy

We do not log any browsing activity of any kind, not even the bandwidth used by a specific Hoody Key. In addition, the operating system of our servers runs fully in RAM, so we don't have the technical ability to log anything on disk.

We do not have a concept of number of Devices for a specific Hoody Key. Instead, we have a concept of currently connected Devices, which is also not logged anywhere. You can use Hoody with an unlimited amount of devices, but not concurrently. Technically, each time a Hoody Key attempts to connect to our secure network, it will check how many other connections are already being established for this Hoody Key.

In order to mitigate DDOS attacks onto our network, we do use firewalls such as iptables and custom security programs. IPv4 and IPv6 addresses spamming our network are stored in RAM, never on disk.

Analytics

We do not condone the fact that most VPN providers use heavy tracking methods such as Google Analytics, as law enforcement can subpoena Google in order to track you down, even behind a VPN.

In order to ensure that we can improve our sales and the performances of our website, we chose an open-source analytics solution which never store IP addresses of visitors. Furthermore, we can't correlate a visitor with a Hoody Key. Even though we only collect non-personal information, all statistics are anonymized. And as part of our extra measures to guarantee more privacy to our users, we delete those data every 7 days.

Cookies

We only use a very few cookies that do not contain or could be correlated to your personal information. Again, we never collect personal information.

Purpose of these cookies are:

- To know if you've already visited our website in order to accelerate the page loading time

- To debug the website via our open-source analytics solution

We never store your Hoody Key under any form in the browser or in the server.

Changes

We may update at any moment our Privacy Policy without notice. We recommend you to review our Privacy Policy from time to time in order to stay informed on our revised rules. However, if any major change is made, we will send a notification in our communities. We can't notify you by email as we do not know and do not want to know your email, because we do everything we can to protect your privacy.
